1. About the Service

3rd Base Coach is a product and service provided by Data Network Analysts ("DNA," "we," "us," or "our") under the 3rd Base Coach brand. DNA operates a data-driven affiliate and referral network offering deal analysis, provider matching, and member benefit programs to consumers and small businesses.

The service is accessible at rounding3rdbase.com and via the 3rd Base Coach mobile application.

2. Eligibility

You must be at least 18 years of age to use 3rd Base Coach. By using the service, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

3. Estimates & No Guarantees

Specifically:

• Deal scores and comparisons are for informational purposes only and do not constitute a guarantee of savings or favorable terms
• Negotiation suggestions are general guidance, not guaranteed outcomes
• Provider matches are based on availability and network membership — DNA does not guarantee the quality, licensing, or performance of any matched provider
• You must independently verify all final terms, pricing, and conditions in writing before making any purchase, signing any agreement, or entering any financial commitment

DNA is not liable for any decisions made based on app outputs or recommendations.

4. Data Sharing & Affiliate Network

By using 3rd Base Coach, you explicitly agree to the following data practices as a condition of service:

• DNA may share your information with affiliates and network members as needed to complete app services, including referral matching, vendor partnerships, and discount programs
• DNA reserves the right to use your data for targeting, analysis, and remarketing across the DNA affiliate and member network
• When you request a provider match or referral, your contact information and relevant deal details will be shared with matched member businesses to facilitate the connection
• Your information may be used to contact you with relevant offers, partner promotions, and service updates from DNA and its affiliate network

Acceptance of data sharing with affiliates and the DNA network is a condition of using the app. If you do not consent to this data sharing, you may not use the service. See our Privacy Policy for full details on how your data is collected, used, and shared.

5. User Responsibilities

You agree to:

• Provide accurate and truthful information when using the service
• Use the service only for lawful purposes and in accordance with these Terms
• Not attempt to reverse-engineer, scrape, or otherwise misuse the service or its data
• Not use the service to harass, defraud, or harm any other person or business
• Verify all deal terms independently before making any purchase or financial commitment

6. Account & Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at 3rdbasedivision@topdatadna.com if you suspect unauthorized access.

7. Intellectual Property

All content, trademarks, logos, software, and materials associated with 3rd Base Coach are the property of Data Network Analysts or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Third-Party Services & Providers

DNA facilitates connections between users and member businesses or vendor partners. DNA is not a party to any agreement between you and a matched provider. We do not endorse, warrant, or guarantee the services of any third-party provider in our network. Any disputes with a matched provider must be resolved directly between you and that provider.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DNA AND ITS AFFILIATES, OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Reliance on any estimate, recommendation, or comparison provided by the app
• Outcomes of any transaction or agreement entered into based on app outputs
• Actions or failures of any matched provider or affiliate network member

DNA's total liability to you for any claims arising from use of the service shall not exceed the amount you paid to DNA in the 12 months preceding the claim, or $100, whichever is greater.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. DNA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Termination

DNA reserves the right to suspend or terminate your access to the service at any time, for any reason, including violation of these Terms. You may delete your account at any time by contacting us at 3rdbasedivision@topdatadna.com. Data deletion requests will be processed pursuant to our Privacy Policy.

12. Changes to These Terms

DNA may update these Terms of Use from time to time. We will notify you of material changes by posting the updated Terms at this URL with a revised effective date. Your continued use of the service after the effective date constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable under applicable law.
